Please make sure that you read this section as these are the conditions that you agree to when you book
It is the client’s responsibility to check the reservation and ensure that the particulars contained therein are correct. The client shall pay Avventura Pilates Ltd a non-refundable deposit in the sum of 25% of the total amount due for each person named in the reservation. If payment of either the deposit or the balance is not received by the due date, Avventura Pilates Ltd reserves the right to cancel the reservation and retain the deposit. Your booking and deposit will be confirmed by email. Receipt of full and final amount payable will also be confirmed by email. In order to be accepted on a retreat we request that you complete and return a health questionnaire. This will be sent to you by email. Your booking is not considered definite until Avventura Pilates Ltd receives full payment for your entire retreat.
Full payment from the client must reach Avventura Pilates Ltd 60 days before the start of the retreat. All financial transactions, retreat administration and information distribution will be done through Avventura Pilates Ltd office. Once confirmation is dispatched, your contract is made with Avventura Pilates Ltd and the deposit is non-refundable. Deposits may be claimable on your insurance, subject to terms. If we do not receive payment within the agreed timeframe, Avventura Pilates Ltd reserve the right to cancel your place. Avventura Pilates Ltd also accepts payment by bank transfer to our UK bank account. We will email you our bank details upon request. Unless otherwise agreed in writing, the price is the exact amount to be received by us. If you choose to pay by electronic transfer, please instruct your bank to charge all costs to you in order to avoid a shortfall in the amount we receive. In the event of Avventura Pilates Ltd being charged a commission fee by the bank, this fee will be added to your account to be paid by you. Full payment received is taken as confirmation of agreement to the Avventura Pilates Ltd booking terms and conditions.
Should our costs increase due to currency fluctuation, Avventura Pilates Ltd reserves the right to surcharge on the following items: government action, currency. Even in such events, we will absorb an amount equivalent to 2% of the holiday price excluding amendment charges. No surcharge will exceed 10% of your holiday price, excluding amendment charges and no surcharge will be made within 30 days of the start of the retreat, except on bookings within 30 days where any surcharge would be shown on your invoice €1.20 to equal £1.00.
4. Alteration to your holiday by the company
It is unlikely that we will have to make any changes to your holiday, but occasionally changes may be made, which we reserve the right to do at any time. Changes can include alteration of venue, teacher, chef, activities guide and activities (this is not an exhaustive list). If we do have to amend your holiday, it will be due to circumstances outside of our control and we will advise you at the earliest possible date. If you decide to cancel your booking after this point, the cancellation fees in section 6. Cancellation of Holiday will apply.
5. Amendment fees
Avventura Pilates reserves the right to charge £45 per alteration, should you wish to change your original booking subject to the following conditions. Amendments include: changing number of guests (reduction of addition), retreat location and guest details (this is not an exhaustive list and there may be other amendments which incur a £45 administration fee). Requests for amendments must be made 12 weeks before the start of the retreat. If we are unable to make alterations as you requested (for example due to other retreat being booked up, or we are unable to sell your space) and you do not wish to continue with the booking, then our cancellation charges apply.
6. Cancellation of retreat
Avventura Pilates reserves the right in any circumstances to cancel your retreat. However, in no case will we cancel your holiday less than 60 days before the scheduled start date except for reasons of ‘force majeure’ which include war, political unrest, strikes, acts of God, epidemics, natural and technical disaster, closure of ports and aircraft unless the clients default in payment of the balance of the retreat price. In circumstances where we are unable to provide the retreat you have booked we will return to you all monies paid, or offer you an alternative retreat of similar standards and if the cancellation occurs within 12 weeks of the retreat start date, compensation on a similar scale to that shown in the Cancellation section:
Cancellation: Any booking cancellation must be made in writing to Avventura Pilates Ltd without any due delay. In this event the following cancellation charges will apply: More than 56 days before the first day of your retreat – deposit only. More than 35 days before the first day of your retreat – 60% of total. More than 21 days before the first day of your retreat – 80% of total. 21 days or less before the first day of your retreat – 100% of total. If cancellation of a party member results in under occupancy of a room, those remaining must pay the appropriate empty bed charge.
7. Health requirements
Currently there are no health or vaccination requirements for Britons or Europeans visiting our destinations. We recommend that each client obtains travel insurance prior to their retreat, but also to visit the FCO website for specific requirements to each country.
8. Visa, Passports and Bagage
At some of the locations that Avventura Pilates uses British and European subjects need a valid passport and a visa. Clients are responsible at all times for their own personal documents, baggage and equipment, whether hired or not.
Our contract with you is deemed to be made at the offices of Avventura Pilates Ltd, Lazy Moon Farm, Upper Brailes OX15 5BA. All our conditions are subject to British Law.
Avventura Pilates Ltd retreats start and finish where stated on your invoice. We are not responsible for your travel to or from this point or for any expenses, including travel accommodation, subsistence and loss of earnings, caused by delayed return to your departure point, howsoever caused. Adventure Pilates Ltd will endeavour at all times to maintain their schedule, but there may be delays due to circumstances outside of the control of Avventura Pilates Ltd. Examples of such delay can be caused by bad weather conditions, strikes or road traffic conditions. Adventure Pilates Ltd will not be liable for any loss or damage arising from delays whatever the cause. All clients are bound by the conditions of coach companies and other suppliers of transport, accommodation and services which go to make up the retreat.
These conditions are subject to international agreements between countries and copies may be made available upon request. No representative is authorised to make or promote refunds and no such promise will be accepted by Avventura Pilates Ltd. All clients undertake not to damage their accommodation, and to abide by local regulations (especially in relation to noise). Clients are liable for the cost of any damage to the accommodation and Avventura Pilates Ltd shall be entitled to recover costs from the clients if necessary before homeward transfer. Avventura Pilates Ltd has the right to terminate a retreat if a client is harming the reputation of Avventura Pilates Ltd or causes offence to other clients, owners of Avventura Pilates Ltd or to representatives of Avventura Pilates Ltd, and Avventura Pilates Ltd will have no further contractual obligations to the client. If you are prevented from travelling because in the opinion of any person in authority you appear to be unfit to travel or likely to offend other passengers, our responsibility for your retreat cease and no refund or compensation will be paid.
Avventura Pilates Ltd accepts responsibility for ensuring the retreat you book with us is as described on the website and the services, activities and excursions offered by Avventura Pilates Ltd reach a reasonable standard. If any part the of the package is not provided as promised, we will pay you the appropriate compensation if it has affected your enjoyment of the retreat. Adventura Pilates Ltd is not liable for services that incur an extra cost on the retreat and any activities pursued by yourself.
Avventura Pilates Ltd accepts responsibility for the acts or omissions of our representatives, agents and suppliers save where they lead to death, injury or illness. In respect of the coach or transportation, our liability in all cases shall be limited in the manner provided by the International Convention.
11. Lost & stolen property
Avventura Pilates Ltd will not be held responsible for any theft or loss of personal possessions from our premises or vehicles. Whilst Avventura Pilates Ltd will endeavour to ensure the security of guests’ personal possessions, Avventura Pilates Ltd cannot guarantee it. It is up to client to assume responsibility for the safety of all their own personal possessions, documents and equipment. No responsibility or liability is or will be accepted in respect of such items. All clients should ensure their health and possessions are covered by personal travel insurance.
If any client suffers dearth, illness or injury whilst overseas arising out of activities which did not form part of the excursion or activities arranged by us we shall, at our discretion, offer advice, guidance and assistance to help you in resolving any claim you may have against a third party, providing we are advised of the incident within 90 days of occurrence. Where legal action is contemplated our authority must be obtained in writing prior to commencement of the proceedings and be subject to you undertaking to assign any costs recovered or any benefits under an appropriate insurance policy to ourselves.
Our cost in respect of the above on behalf of you and your party shall not exceed £5,000 in total.
If you wish to make a complaint or claim whilst staying with Avventura Pilates Ltd you must report it to the relevant supplier of the problem in question and to our retreat representatives, thereby giving them the opportunity to remedy the problem. We cannot accept any liability whatsoever if we are not informed immediately of any problem during your stay. Complaints not resolved completely at the retreat venue should be made in writing within 28 days of the end of the retreat. We will not accept liability for claims received after this period.
All the information on the website attempts to be accurate and correct at all times. Due to the nature of the work Avventura Pilates Ltd carries out, the website content is subject to change.
14. Booking process
Avventura Pilates Ltd asks for a deposit to be paid by the online booking system Strip on the website or by bank transfer on booking. Avventura Pilates Ltd cannot confirm booking until the deposit amount has been paid. Adventure Pilates Ltd will follow up with the booking form and invoice for the final amount to be paid within 60 days of the start of the retreat.
